These Terms and Conditions govern the use of the website www.koziel.fr, as well as all viewings and KOZIEL® purchases from 1st December 2014. By viewing this website and/or ordering the products (and/or services) offered by KOZIEL®, you fully accept the Terms and Conditions set below. Please read them carefully. We also invite you to take note of the information provided specifically for private individuals and professional customers. They are available in the general menu of the website and in various other communication materials we publish. Do not hesitate to request them. No sale shall be deemed effective without prior acceptance of these Terms and Conditions of Sale.
According to the Hamon law (2014-344 Act of 17th March 2014 relative to consumption, KOZIEL informs you that any order placed on our website represents an order with payment obligation. What we consider as an order is a shopping cart lead until clicking on the “finalize my order” button.
All prices displayed on our website are in euro only, inclusive of VAT. The VAT rate is 20%. For purchases made outside France but within the EU, prices are exclusive of VAT. In this case, the VAT amount is deducted automatically from your invoice. For purchases made outside the EU, all applicable taxes and custom duties shall be borne by the customer, in addition to the cost of our service. The costumer is informed about the accurate amount of duties and taxes, once the goods are arrived in the destination country. Full payment must be paid before shipping.
3. METHOD OF PAYMENT
Payments can be made by one of two methods: (1) by credit card : Online payments in one go are secure and guaranteed by Payplug. No confidential bank data is transmitted through the online sales site. KOZIEL reserves the right to suspend the order and the delivery in case of refusal of authorization of payment by the banking centre.; (2) by bank transfer. Once your payment is recorded, your order will be processed immediately. For faster processing of your order, we strongly recommend payment by credit card. Cash payment, payment on delivery and Pay Pal is not accepted.
ALMA FREE CREDIT PAYMENT OPTION
Payment of your order in 2 or 3 installments by credit card from 250€ of purchases up to 3000€ with Alma Our partner Alma offers you a financing solution called which allows you to pay for your purchases from 250€ to 3000€ in 2 or 3 times with your bank card.
Conditions: This offer is reserved for private individuals and professionals (natural persons of legal age) residing in France and holders of a Visa, American Express and MasterCard bank card with a validity date greater than the duration of the chosen financing. Cards with systematic authorization, in particular of the Electron, Maestro, Nickel type, etc., as well as e-cards, Indigo and American Express cards are not accepted.

You are then redirected to our partner's Alma web page displaying the detailed summary of your order and the personalized financing request, which you must then validate.
You enter your personal information.
You read the general conditions of payment in installments to which you wish to subscribe which are provided to you in PDF format so that you can read, print and save them before accepting them. You then notify your electronic acceptance by the corresponding checkbox.
You acknowledge that the "double click" associated with the checkbox on the acknowledgment of the general conditions constitutes consent to contract and constitutes irrevocable and unreserved acceptance of the general conditions of the product.
Unless proven otherwise, the data recorded by Alma constitutes proof of all transactions between you and Alma. If you request to benefit from a financing solution offered by Alma, the information relating to your order will be transmitted to Alma, which will use it for the purpose of studying your request for the granting, management and recovery of credit.
Alma reserves the right to accept or refuse your financing request in 2x 3x.
You have a withdrawal period of 14 days to give up your credit.
Operation: Payment in 2 or 3 installments by credit card allows you to pay for the order placed on our merchant site as follows: - a compulsory contribution, debited on the day of confirmation of the dispatch of your order corresponding to half or to a third party of the order; - two or three monthly payments, each corresponding to a half or a third of the order, withdrawn 30 and 60 days later for the 3 times and 30, 60 and 90 days later for the 3 times.
A credit commits you and must be repaid. Check your repayment capacity before you commit.
4. REFUND AND CLAIM
KOZIEL is committed to providing high-quality products. However, if for any reason you are not satisfied with your purchase, you may return the item(s) within 14 days from reception date. Please note that this provision does not apply to tailor-made or customized items. To return an item, please first send an email to firstname.lastname@example.org, specifying your reference details and the reason of the return. The item should be free of defects, perfectly protected and returned in its original packaging. Return shipping costs shall be paid by the customer. Damaged or incomplete returns will not be accepted. You can contact us by email at any time with your comments and feedback. We insure you to reply as quickly as possible. Every professional who ordered with professional rates won’t benefit of the withdrawal period previously detailed.
KOZIEL cannot be held responsible for a wrong hanging of the product or a wrong use of the hanging tools. The responsability of the implementation belongs to the sole customer. Stop hanging wallpaper if after 3 lenghts you notice faults or imperfection. Supplier’s responsability will cover only the cost of this material excluding labour cost or other expenses.
The bank charges of 9€ (excluding VAT) are at the sole charge of the customer in case of a refund by bank transfer to a bank account located outside of the European Union. The €9 fee (excluding VAT) will be directly subtracted from the amount refunded.
5. PACKING AND SHIPPING COSTS
Each order is shipped as a reinforced cardboard parcel for optimal protection during transport. UPS delivers all shipments; except for some few areas UPS do not deliver. You or anyone must be present to receive the delivery. Shipping costs are added to the total amount, and depend on the overall size and weight of your order.
Orders will only be shipped once full payment has been received and processed. Otherwise, the merchandise will not be shipped and remain the property of KOZIEL. Orders including products in stock will be delivered within 2 to 7 working days(excluding Saturdays and Sundays). Delivery times depend on the availability of products and raw materials, requested graphic-editing work, and the bank checks required when processing payments. In the event of a delay, we will inform you (primarily by e-mail) of the length of the delay and the conditions of delivery of the merchandise. KOZIEL ships customers' orders through private carriers. Once your order has been confirmed and processed, we will send you a notification of shipment e-mail. For legal reasons, mainly to do with parcel insurance, we currently cannot accept orders to certain countries. Please contact our Sales Department for further details. The shipping costs include the cost of packaging and the actual cost of shipment, which is based on the total volume and weight of the ordered items. When ordering from KOZIEL®, you're responsible for ensuring the product can be lawfully imported to the destination country. The recipient is the importer of record and must comply with all laws and regulations of the destination country. The destination country may subject to import taxes, customs duties and fees levy orders shipped outside ofFrance. The recipient of an international shipment may be subject to such import taxes, customs duties and fees, which are levied once a shipment reaches the recipient's country. Additional charges for customs clearance must be borne by the recipient; we have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country; you should contact your local customs office for more information. When customs clearance procedures are required, it can cause delays beyond our original delivery estimates. If the costumer rejects to pay the import taxes, customs or any other duties, the amount paid by KOZIEL®, because of taxes and shipping back to the warehouse, will be deducted from the total refund. KOZIEL® can choose between destroying the goods (with no refund for the customer) or returning the goods to the warehouse (see above about refund). Any order removing from our warehouse, once leaving the warehouse is not insured by KOZIEL® anymore.
7. TAILOR MADE PRODUCTS
What we consider as a tailor-made item is any item from our catalogue that will be modified on: color, size, or design or/and any original creation outside our catalogue. For all tailor made orders, the costumer shall make a 50% deposit payment before the graphical and technical management of the file by KOZIEL®.Production time starts from the confirmation of deposit payment. Before delivery or withdrawal to the warehouse, costumer shall cover the total amount of the purchase. KOZIEL do not accept return for tailor-made products (unless hidden defect is found). Extra changes will have extra charges. Tailor-made orders are registered and launched into production only after receipt of a purchase order or signed quote, buffered with the“Agreed and signed” mention form the customer.
8. EXPORT CONDITIONS
Any order involving merchandise export must be paid completely prior to its withdrawal by the care of the client or his departure from our warehouse by a carrier. No refund is accepted.
9. YOUR PERSONAL INFORMATION
As a customer, you acknowledge that the personal data you provided at the moment of your registration and/or your order is accurate, up-to-date and complete in all respects. You agree to refrain from misappropriating the identity of any another person or company, or from using a false name or any other name that you are not entitled to use. Pursuant to the French Data Protection Act (loi informatique et libertés), KOZIEL will not to disclose your personal data to any third party for commercial purposes without your prior consent.
10. SAFETY STANDARDS
All our wallpapers and PVC Impostures Visuelles® are treated to comply with M1 (non flammable) standards. The plastic is chemically treated in this way as a passive fire-prevention measure. The purpose of the treatment is to retard the out break of fire in certain materials when exposed to a heat source or directly to a flame, and to prevent the spread of fire. This standard is recommended(and in some cases even compulsory) for professionals, and when the products are used on surfaces of 0.5 m2 or larger. The chemical treatment might cause a tiny escape of odors when opening the package, which will disappear very quickly. Our velvet wall covering are not treated to comply with M1 standards. KOZIEL® can produce them in M1 standards if needed, contact us and we will give you a specific quote.
11. DISPLAYS AND TRANSPORT
KOZIEL products are intended exclusively for indoor use, and should be displayed in a clean, dry place at temperatures between 5 and 35°C. Outdoor use, even temporary, is to be avoided. Our products should never place near a source of intense heat (radiators, heaters, fireplaces, stoves...) as this could cause a permanent deformation in the product. Similarly, our products should never be exposed to direct sunlight (which could cause discoloration). The anti-UV treatment, to which the inks used in our products have been subjected, does not guarantee optimal colorfastness in extreme conditions. Our products should be handled with care during transport and manipulation. They should never be left lying on the ground (or suspended from a ceiling) without the appropriate wall mounts as they may become deformed and/or tear under their own weight.
The product should be cleaned by wiping with a soft cloth, either dry or with softened water, or with an alcohol-based window-cleaning product. Use of any other chemical product may cause irreversible damage to the product.
Except for candles (1 year warranty), KOZIEL® products carry no guarantee unless a latent defect has been established.
Non-calibrated computer, tablet or phone screens can distort the item’s colors or tones. The colors on our PDF or printed catalogues are for information purpose only non contractual. Besides, the colors of the products can be slightly different depending on productions and on the material (wallpaper, polyester, PVC…): this is the batch principle.
15. "OUTLET" ITEMS
The products displayed in the category "OUTLET" are discounted products: products used for demonstration, products sold without their original packaging, incomplete rolls, discontinued references... (non-exhaustive list). Full description of the product is provided, the "OUTLET" products being sold as they are. The "OUTLET" products' prices are discounted up to 90% off the recommended sale price. The "OUTLET" products can be neither returned nor exchanged. The right to return does not apply to "OUTLET" products.
16. TRADEMARK RIGHTS AND COMMERCIAL AND INTELLECTUAL PROPERTY
KOZIEL® and IMPOSTURES VISUELLES® are registered French trademarks. The resale of our products under any other name, brand or mark is strictly forbidden. Any reproduction, even partial, of our branded products, is forbidden. Any infringement of these provisions is liable to prosecution. All KOZIEL communication materials and their content (including the website) are protected under the French Act of 11 March 1957. Any representation or reproduction, in whole or in part, without the prior consent of the owner or the latter's beneficiaries or assigns, is unlawful (Indent 1 of Article 40). Such representation or reproduction, by whatever process, would constitute an infringement of copyright punishable by law under Articles 425 and following of the former Criminal Code. It is strictly forbidden to use any text, image or part of an image from this website on any other website, or in any other communication material or document.
17. SPECIAL OFFER
Please note that special offers promoted on koziel.fr website do not include any related shipping expenses. Special offers cannot be combined with any additional offer otherwise clearly stipulated in the terms of the offer.
By ordering wallpaper samples, you acknowledge that these items will not be returned, replaced, nor refund. Therefore, these items are not eligible to the CGS section 4 policy.
In case the customers give a file(s) to KOZIEL, KOZIEL is not responsible of the images used and provided by the customer. By any way possible, customer has to make sure the files are not protected by any artistic property or any trademark. KOZIEL declines any responsibility in case of abusive use. Customer agrees on the existence on a copyright in his favor when ordering an item that is submit to the copyright protection from the law.
20. LEGAL PROVISIONS
While we have taken every effort to ensure that the content of this website is accurate, KOZIEL may not be held liable for the accuracy of the editorial content. Photographs are not contractual. All rights reserved. All products are sold subject to their description, which specifies the specifications of the product. All of our products are offered subject to availability. KOZIEL reserves the right to change any or all of the models offered for sale, and to remove or add models and/or products without notice. All of the products sold under our brand are designed and manufactured in metropolitan France or Western Europe.
If there is any dispute between KOZIEL and the customer, the place of jurisdiction will be the Commercial Court of Roubaix-Tourcoing. Any close to the contrary shall be deemed null and void. The fact of ordering or accepting the order confirmation involves the customer agreement on the above conditions.
